H-1B1 Visa

If you are a national of Chile or Singapore, the H-1B1 is an excellent visa category.

That is because the H-1B1 visa is a country specific visa available only to Chilean and Singaporean citizens to work and live in the US.  Work permission may be given for 18 months and may be extended. This is a great option for professional workers and also allows spouses and children to accompany them to the US.

 Primary Eligibility Requirements:

 Primary Eligibility Requirements:

  • The job must be considered a “specialty occupation,” meaning that it requires the application of specialized knowledge. This includes such fields as engineering, science, medicine and health care, education, technology, agriculture, and business specialties, including human resources and management.

  • The applicant must have a four-year college degree or have work experience that is equal to a degree, as determined by an independent credentialing agency.

  • The applicant must be employed by an existing US company in the US rather than self-employed or working as an independent contractor

  • The employment period is temporary, and the applicant must demonstrate an intent to return to their home country after the job terminates

Examples of Successful Cases that Qualify for an H-1B1

We have handled many successful H1B1 visa applications. The educational criteria is the same as listed for the H-1b. Please refer to that article for examples of potential job categories.

Advantages of the H-1B1 include:

  • The applicant may apply for the H-1B1 directly at the US consulate instead of first gaining approval from the US Department of Homeland Security.

  • Employment start date at any time of year (because the yearly quota has never been met).

  • Minimal government filing fees

  • Applicants may ask for 18 months of work authorization and may renew

Green Card Procedures for H-1B1 Visa Holders:

We know how valuable well trained, professional employees are to the success of your business. It is not advisable to file for a green card while in H-1B1 status. When your H-1B1 employee is someone you’d like to retain long term, we can assist you in switching them to an H-1B or another visa category so they can obtain a green card.
